CNCD sanctioned the racial segregation of Roma children in two schools in Iași and Suceava counties.

Center for Advocacy and Human Rights (CADO) say hello the decisions of the National Council for Combating Discrimination (NCCD) by sanctioning the School, "Bogdan Petriceicu Hasdeu" -Iasi, Romania Iasi County School, Secondary School “Mihail Sadoveanu” Falticeni, Suceava, and Suceava County School Inspectorate, for the segregation of roma children.

In the month of April, 2016, the Center for civil society and Human Rights (ECHR) by ms Advocate, Mihaela Roxana Prisăcariu, he filed two complaints with the National Council for Combating Discrimination (CNCD) in case of:

(a) a School, Bogdan Petriceicu Hasdeu Iasi County School Inspectorate of Iasi, because the segregation of roma children in the body of the school and the quality of the educational process in the body of the school. The specific reasons for the filing of the complaint was that, in the context of this school, the students learn the 7 buildings, but the majority of the pupils of roma origin have been housed in building C, reaching, according to data provided by the school, more than 50% of the total number of students out of the body. A group of parents, the romani people have complained about the quality of the educational process in the body where the majority of the kids, even after the completion of the class, the Initiative is not able to read and write correctly by the fact that the majority of teachers are the custodians or the pension re-employed. For this reason, his parents tried to register/transfer a child to another body, a school within the same school, but they were turned away.  

(b) that is part of the “Mihail Sadoveanu” the City, in the county of Suceava, and the ministry of education of the County of Suceava for the segregation of the classes for roma children. Within the framework of the monitoring of the school segregation of roma children in Botosani, Iasi, Neamt, Suceava, Vaslui, the ECHR has found that, in the framework of the School, Michael Savoveanu in the 2014-2015 school year, and although the students of the roma population accounted for only 10% of the total number of the students, they were all together in separate classes. More specifically, class I, IV, VI, and VII, the roma were among the 39%-56% of the total number of students in the class divided by the time in each of the other classes of parallel there isn't a student of the romani people.

The investigation of these two cases, the separation was carried out with the help of local non-governmental organizations, The association of the Pro-home-Iasi and The association of Consultants for the Development of the Community'swho participated in a programme for the development of the ability to search in the monitoring of the gender segregation in the education of roma children being implemented by the ECHR and the The Resource center for Public Participation (Required) in the framework of the project “School for all the kids!!”, funded by the EEA grants 2009 – 2014, as part of the NGO fund in Romania.

CADO complained to the CNCD both the active role of schools in the ethnic separation of Roma students but also the passivity of the county school inspectorates in fulfilling their responsibilities regarding the prevention and combating of school segregation in the two school units according to Order no. 1540 of 2007 regarding the prohibition of school segregation of Roma children and the approval of the Methodology for the prevention and elimination of school segregation of Roma children.

THE in both of these cases, the it was decided that the division into classes, and putting it in one wing of the building of the roma children's school has several buildings, i.e. the tolerance of these statements by the two boards of education, county of Iasi and Suceava; it represents discrimination and the violation of the law of the the dignity in accordance with article 2, para. 1, article 2, par. 4, art. 11, paragraph 1, and article.15 of the government ordinance no. 137/2000 on preventing and sanctioning all forms of discrimination.  

Also, the fine administrative fine of £ 3000 to School "Bogdan Petriceicu Hasdeu" -Iasi, romania 5000 lei, the County School Inspectorate of Iasi, and by the year 2000 lei, the School district of the County of Suceava, and has asked the schools and the county school inspectorates, to start the implementation of plans for the desegregation up-to-date 01/10/2017.

At the same time, CADO expresses its disappointment with the approach of the Ministry of National Education and Scientific Research, which by address 6137/17.10.2016 sent to the CNCD stated that CADO's complaint against the Bogdan Petriceicu Hasdeu School and the Iași County School Inspectorate regarding the segregation of Roma children in body C as unfounded, the same ministry that in December 2016 approved Order 6.134/21.12.2016 regarding the prohibition of school segregation in pre-university education units. The contradiction between the two approaches of the ministry shows that, unfortunately, preventing and combating segregation in education is only at a declarative level and not a real interest of the ministry.
